Parashakti Agri Seva Pvt Ltd — Shaktigram Platform and Application

These Terms of Use ("Terms") govern your access to and use of the Shaktigram website and application (the "Platform"), operated by Parashakti Agri Seva Pvt Ltd ("Company", "we", "us"). Your engagement as an enumerator — including pay, deployment obligations, and confidentiality — is governed exclusively by the separate Enumerator Agreement. Your personal data is handled in accordance with our Privacy Policy.

1. Acceptance

By accessing the Platform or registering as an enumerator, you agree to these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract in India.

3. The service and pilot status

The Platform supports field data collection and related survey workflows. The Platform is currently offered as a pilot. Features may change, be limited, or be withdrawn, and availability is not guaranteed during the pilot.

4. Your account

You are responsible for the accuracy of your registration details and for keeping your login credentials secure. Notify us promptly of any unauthorised use of your account.

5. Acceptable use

You agree not to:

• submit false, fabricated, or falsified survey data;
• collect data without first presenting the required Respondent Notice and recording the respondent's consent;
• access or attempt to access data beyond your assignments;
• copy, export, screenshot, or share data collected through the Platform except as authorised;
• reverse-engineer, disrupt, or otherwise misuse the Platform.

Breach may result in suspension, termination, withholding of payment for affected work, and legal action.

6. Ownership of data and intellectual property

• Data collected through the Platform is collected for and owned by the Company and/or its client, as applicable. You acquire no ownership of, or licence in, that data.
• The Platform, software, methodology, survey instruments, training materials, and the Rural India Pulse dataset are the Company's intellectual property.
• Aggregated and de-identified data derived from collected data may be used by the Company for its analytics and data products, consistent with the Privacy Policy.

7. Commercial terms governed separately

Payment, rates, deployment obligations, and confidentiality are governed exclusively by the signed Enumerator Agreement and are not part of these Terms. In the event of any inconsistency on these matters, the Enumerator Agreement prevails.

8. Limitation of liability

The Platform is provided "as is" during the pilot. To the extent permitted by law, the Company is not liable for indirect, incidental, or consequential losses. To the extent permitted by law, the Company's total aggregate liability arising out of or relating to the Platform is limited to the lower of (a) INR 5,000, or (b) the total fees paid to you in the three months preceding the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law (including liability for fraud or gross negligence).

9. Termination

We may suspend or terminate your access for breach of these Terms or the Enumerator Agreement. You may stop using the Platform at any time.

10. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, seated exclusively in Ahmedabad, Gujarat. Hearings may be conducted virtually. Subject to the arbitration agreement, the courts at Ahmedabad have exclusive jurisdiction.

11. Changes

We may update these Terms and will post the revised version with a new effective date. Continued use of the Platform after an update constitutes acceptance.
